UPDATE: Justin Timberlake will not be investigated for the voting booth selfie he shared on social media. Though the Shelby County DA’s office originally told EW that his illegal photo was “under review,” Amy Weirich, the district attorney general of Shelby County, negated that statement on Twitter.

“The statement released earlier today regarding Justin Timberlake and an investigation was incorrect and was released without my knowledge,” she said. “No one in our office is currently investigating this matter nor will we be using our limited resources to do so.”

EARLIER: Justin Timberlake’s enthusiasm for voting has placed him in some hot water.

On Monday, Timberlake snapped a photo of himself in a voting booth in his home state of Tennessee, encouraging his 37 million Instagram followers to vote in the upcoming election.

“I just flew from LA to Memphis to #rockthevote!!! No excuses, my good people! There could be early voting in your town, too,” he captioned the photo.

Unfortunately for Timberlake, Tennessee law prohibits voters from using a phone for conversations, recording, or taking photos or videos while inside the polling place.

“The Shelby County DA’s office was made aware of a possible violation of state election law,” the Shelby County DA’s office told EW in a statement. “The matter is under review of the DA’s office. The law itself TCA2-7-142(B). The offense is a state class C misdemeanor. Any person convicted of this violation could be sentenced up to 30 days or fined no more than $50 or both.”

The law was implemented last year; Timberlake would become the first person prosecuted for breaking the law, should the DA office move forward with any charges.

Timberlake’s rep was not immediately available for comment.

The singer didn’t say which candidate he voted for in the presidential election, but he is an avowed supporter of Democratic nominee Hillary Clinton. Back in August, Timberlake and his wife Jessica Biel posed for a photo with Clinton; each star included the Clinton hashtag #ImWithHer in the social media posts.
